Dear Professional Home Inspector,
On the day before Thanksgiving 2006, I received a telephone call from a home inspector in Florida. He wanted to know if I could advise him with respect to a demand letter seeking money damages for alleged negligence that he had just received from an attorney regarding a home inspection that he had conducted some twenty (20) months before.
SEEKING MONEY DAMAGES TWENTY MONTHS AFTER INSPECTION!!!
I asked him to send me the attorney's demand letter, his pre-inspection agreement and his inspection report. After reviewing the material that he had sent me, I was considerably astonished to discover that the 'deficiencies' for which the attorney was seeking damages had been present at the time of the inspection and had been called out in the inspector's report.
THREATENED WITH A LAWSUIT FOR ITEMS THAT HE CALLED OUT!!!
I responded to the demand letter on the inspector's behalf and advised the claimant's attorney (a) that the claim was invalid because the inspector had called out the deficiences that were the source of his client's complaints; (b) that should a claim be brought on the spurious grounds outlined in his demand letter, it would be defended vigorously; and (c) that following the inspector's certain vindication in that litigation, he would be seeking damages from both the attorney and his client.
We never heard from that attorney again.

Following that experience, I surveyed a number of inspectors and discovered that frivolous lawsuits were a major issue for the profession. So combining my knowledge of the home inspection industry and my twenty-plus years of experience as a practicing trial lawyer, I developed a system that, if followed consistently, will dramatically reduce and virtually eliminate your exposure to frivolous lawsuits.
FRIVOLOUS LAWSUIT THREATS ARE THE BANE OF THE PROFESSION
I subsequently developed a seminar for the home inspection industry to teach my system. It was quickly approved by the American Society of Home Inspectors (“ASHIâ€) and the National Association of Certified Home Inspectors (“NACHIâ€), the Commonwealth of Massachusetts and the State of New Jersey for four (4) Continuing Education credits.

The Seminars are always held at Marriott Courtyard Hotels located approximately 10 to 15 miles outside major US Cities. I choose these venues because they are located close to major highways and usually have free parking. They typically have a maximum seating capacity of 30, however, so it is important to register early to ensure that you will be able to attend.
The seminars run from 9:00 a.m to 1:00 p. m.
